2. Software Status and Availability

As-Is Basis: The current version of Ad-Preflight is provided "as-is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Software will be error-free, uninterrupted, or meet your specific requirements.

Pro Version: We reserve the right to introduce paid subscription plans (Ad-Preflight Pro) for advanced features, including but not limited to the --deep validation functionality. Free features may be limited, and access to Pro features will require a valid subscription.

Changes and Updates: We may modify, suspend, or discontinue any aspect of the Software at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Software.

3. Intellectual Property Rights

Ownership: Ad-Preflight, including its source code, object code, documentation, and all related materials, is protected by copyright, trademark, and other intellectual property laws. All rights, title, and interest in and to the Software remain with Ad-Preflight.

Code Protection: The Software's code is protected through minification and obfuscation techniques. Any attempt to reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software is strictly prohibited.

License Circumvention: Any attempt to circumvent, bypass, or disable the Software's licensing system, including but not limited to tampering with license validation mechanisms, is expressly forbidden and may result in legal action.

License: Your use of the Software is governed by the license terms specified in the Software's LICENSE file. Unauthorized use, copying, or distribution of the Software is prohibited.

4. Limitation of Liability

No Warranty: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AD-PREFLIGHT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

Ad Platform Rejections: We are not responsible for any ad creative rejections by advertising platforms (including but not limited to Google Ads, Facebook, DoubleClick, or any other platform), even if such rejections occur after validation by Ad-Preflight. Platform policies and requirements may change without notice, and validation by our Software does not guarantee platform acceptance.

Validation Errors: We are not liable for any errors, inaccuracies, or omissions in the validation process. While we strive for accuracy, the Software may not catch all potential issues, and platform requirements may vary or change over time.

Limitation of Damages: IN NO EVENT SHALL AD-PREFLIGHT, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE SOFTWARE.

5. User Responsibilities

You are responsible for:

Ensuring that your use of the Software complies with all applicable laws and regulations
Verifying that your ad creatives meet the specific requirements of your target advertising platforms
Maintaining the security of your license credentials and Machine ID
Using the Software in accordance with these Terms and any applicable license agreement

6. Prohibited Uses

You may not:

Reverse-engineer, decompile, or disassemble the Software
Circumvent or attempt to circumvent any licensing or security mechanisms
Use the Software for any illegal or unauthorized purpose
Remove or alter any copyright, trademark, or proprietary notices
Distribute, sublicense, or resell the Software without explicit written permission

7. Termination

We reserve the right to terminate or suspend your access to the Software at any time, with or without cause or notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Software will immediately cease.
